Description

In a 2004 decision applying Florida’s Valued Policy Law, Mierzwa v. Florida Windstorm Underwriting Association, 877 So.2d 774, 781 (Fla. Fourth DCA, 2004), Florida's 4th District Court of Appeals engaged in an analysis of coverage that basically rewrote Florida coverage law, created confusion and controversy among insureds and their carriers, and spawned significant follow-up litigation to correct a flawed interpretation of law and great inequities in property insurance. Fortunately, the Florida Supreme Court ultimately corrected the problem with its decision in Florida Farm Bureau vs. Eugene Cox, SC06-2494, FL Supreme Court (2007).

This course traces the odyssey of Florida’s valued property law since its inception, through the challenges of the Mierzwa decision and actions taken to bring Florida’s valued property law back to its “plain meaning.” The course is a must for public adjusters to ensure appropriate representation of a homeowner’s insured property interests, particularly when dealing with wind vs. flood issues, calculating payable loss under the value policy doctrine, and understanding the interpretations, principles, arguments and counterarguments that support the positions taken when dealing with valued policy laws.

For this reason, we will discuss the discuss not only the traditional adjusting practices of staff and independent adjusters, but also the challenges that public adjusters face when losses are laced with valued policy issues.
