(FLPA #75043) Punitive Damages for Public Adjusters- FLPA #75043
It is an insurance carrier’s contractual and moral obligation to comply with the terms of the insurance policies it provides to homeowners and businesses across the nation. Yet unscrupulous carriers and/or their representatives often choose to ignore these obligations, and just as often they get away with it. As sad as it may seem, the primary reason for this is that the pursuit of “justice” for actions in contract do not provide the same lucrative incentives for legal practitioners as does the American civil tort system. Quite often, the only “justice” available to a consumer who has suffered such egregious behavior by an insurance carrier is the chance of an award of punitive damages to punish the guilty carrier and deter such future behavior.
