Description

It is an insurance carrier’s contractual and moral obligation to comply with the terms of the insurance policies it provides to homeowners and businesses across the nation. Yet unscrupulous carriers and/or their representatives often choose to ignore these obligations, and just as often they get away with it. As sad as it may seem, the primary reason for this is that the pursuit of “justice” for actions in contract do not provide the same lucrative incentives for legal practitioners as does the American civil tort system. Quite often, the only “justice” available to a consumer who has suffered such egregious behavior by an insurance carrier is the chance of an award of punitive damages to punish the guilty carrier and deter such future behavior.

This course is a must for Public Adjusters in today’s insurance environment in order to properly represent their clients in matters of first party property insurance. The course is designed to provide public adjusters with an overview of punitive damages, their foundation and limitations, their insurability on a state-by-state basis, and why such insurability is not an issue in matters of first party contract. We will also make an effort to provide an overview of trends involving punitive damages, the awards that have been rendered by judges and juries over the years, and a few of the more significant substantive and procedural issues surrounding punitive damages.

This course has been certified by the Florida Department of Financial Services for 3 Florida Public Adjuster Law CE under Course #75043.

*Important!DON'T DUPLICATE YOUR EFFORTS by repeating a course you've already taken! Florida DFS only allows a course to be taken once in a three year period. If you think you may have taken the course before, just review your CE transcript by visiting My Profile on the Florida DFS website. Compare the course number to make sure that you haven't previously taken the course in the past 3 years. And don't focus on the course title! It's the course number that counts. If you're still not sure, call us first at (800) 820-4550. Your time is valuable. Don't waste it taking a course that will not count towards your current CE compliance period!
